To amend Title 3 of the Yap State Code by amending Section 158 concerning the vacancy in the Office of the Governor and Lieutenant Governor, by adding a new Section 159 concerning the succession in the Office of the Lieutenant Governor, and for other purposes

Be it enacted by the Legislature of the State of Yap.

Section 1

Section 158 of Title of the Yap State Code is hereby amended to read as follows:

“Section 158. Vacancy in Office of Governor and Lieutenant Governor. A vacancy in the Office of Governor or Lieutenant Governor shall be determined by the State Court upon presentation to it of a resolution declaring the ground of the vacancy, adopted by a vote of two- thirds (2/3) of the members of the Legislature. Upon the declaration of vacancy for the Office of the Governor, the Lieutenant Governor shall be sworn in immediately as the Governor.”

Section 2

Title 3 of the Yap State Code is hereby amended by adding a new Section 159 to be read as follows:

“Section 159. Succession for the Office of the Lieutenant Governor. A vacancy declared for the Lieutenant Governor shall be filled by the Governor appointing such person and the Legislature shall confirm in a vote of three-fourths (3/4) of the members. An appointment that is not acted on within thirty days of receipt by the Legislature shall be deemed withdrawn. No person may be appointed more than once for the Office of the Lieutenant Governor.”

Section 3

This Act shall take effect upon the approval by the Governor, or upon its becoming law

without such approval.
