To amend Title 11 of the Yap State Code by amending Section 1302, to prohibit the sale or distribution of tobacco products to individuals under the age of 21, and by adding a new Section 1304, pertaining to vaping, and for other purposes

Be it enacted by the Legislature of the State of Yap.

Section 1

Section 1302 of Title 11 of the Yap State Code is hereby amended to read as follows:

“Section 1302. Providing harmful products to minors.

(1) No manufacturer, retailer, distributor of tobacco products or other person shall sell, give or otherwise provide or distribute cigarettes, cigars, pipe tobacco, chewing tobacco, snuff or other tobacco products to a person who is not at least 21 years of age.

(2) To ensure compliance with section 1301 and section 1302 subsection (1) random, unannounced inspections will be conducted periodically by the Chief of Police, or his designee(s), of retail or other establishments where tobacco products, intoxicating beverages and narcotic drugs are manufactured, sold or distributed.

(3) Any person who violates the provisions of this section shall be guilty of a misdemeanor, and upon conviction thereof shall be fined not more than $5,000 per offense, or imprisoned not more than 30 days per offense, or both.”

Section 2

Title 11 of the Yap State Code is hereby amended by adding a new Section 1304 to read as follows:

“Section 1304. Vaping and vaping devices prohibited.

(1) Vaping is the action or practice of inhaling and exhaling vapor containing nicotine and flavoring produced by a device designed for this purpose.

(2) It is unlawful to engage in the action or practice of vaping.

(3) It is unlawful to possess any device intended for the use of vaping whether or not the device is actually used for that purpose.

(4) Any person who violates the provisions of this section shall be guilty of a misdemeanor, and upon conviction thereof shall be fined not more than $5,000 per offense, or imprisoned not more than 30 days per offense, or both.”

Section 3

This Act shall take effect upon its approval by the Governor, or upon its becoming law without such approval.
