WHEREAS, the Yap State 11th Legislature have reviewed proposals submitted for repair and maintenance of various public projects; and
WHEREAS, the Yap State Legislature is aware that the FSM Congress has appropriated Yap’s share of IMF through PL 23-121 for $1,614,760.00, PL 24-39 for $1,614,760.00, and PL 24-01 for 1,548,400.00, with the Secretary of the Department of Transportation, Communications and Infrastructure (DTC&I) as allottee; and
WHEREAS, the total IMF share for Yap appropriated by the FSM Congress is $4,777,920.00, and was to be deposited into Yap’s IMF sub account, and should be sufficient to fund the repair and maintenance proposals approved by the Yap State Legislature; and
WHEREAS, the National Government has approved funding under the IMF for certain Yap projects without the Yap State Legislature knowledge and approval; and
WHEREAS, the Yap State Legislature is aware of the Compact Fiscal Procedures requirements under Article VII Section 9 of the amended Compact; and
WHEREAS, the Yap State Legislature is requesting the Secretary of DTC&I to work with Yap on any future IMF proposed project to comply with Yap State requirements and laws; and
WHEREAS the 11th Legislature of the State of Yap received a list of projects from the Administration on October 22, 2025, designated as Governor’s Communication No. 11-470 and assigned to the Standing Committee on Finance; and
WHEREAS after deliberations, the Standing Committee on Finance has reported out recommending that the listed projects be funded from the Yap State allocation for Infrastructure Maintenance Funds from the 3rd Amended Compact as all the projects have met the requirements and qualifications for such funding; now, therefore,
BE IT RESOLVED by the Eleventh Legislature of the State of Yap, Third Regular Session, 2025, that the Legislature hereby approves certain maintenance and repair projects in Yap to be funded under the 3rd Amended Compact Yap’s share of Infrastructure Maintenance Fund (IMF); and
BE IT FURTHER RESOLVED that the projects listed in Governor’s Communication No. 11-470 is herein specified as follows:
- Rumuu’, Fanif Intersection Road Damaged Culvert Pipes ($15,796)
- Gilfith, North Fanif Road Shoulder Rehabilitation and Improvement Project ($199,769)
- Kaday Paved Road Culvert Rehabilitation & Improvement Project ($83,384)
- Amun-Muyub Village Road Culvert Improvement Project ($92,968)
- Sea Trans Office Building Roof, Dock Perimeter Fence & Security Guard House ($99,982)
- Yap State Election Office Building Improvement Project ($123,208)
- Yap Guard Rail, Marking Paint, Vertical Sign & Convex Traffic Mirror Installation and Maintenance Project ($227,497.18)
BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the President of the Federated States of Micronesia; the Speaker of the Congress of the Federated States of Micronesia; the Secretary of the FSM Department of Transportation, Communication and Infrastructure; the Governor of the State of Yap; the Director of Yap State Office of Planning and Budget; the Director of Yap State Department of Public Works and Transportation; the Chairman of the Council of Pilung; and the Chairman of the Council of Tamol.
