To further amend Yap State Law No. 11-80, as amended by Yap State Law Nos. 11-104 and 11-107, for additional supplementary appropriation

Be it enacted by the Legislature of the State of Yap.

Section 1

Section 2 in Yap State Law No. 11-80 is hereby further amended to read as follows:

“Section 2. Conditions and Restrictions. (1) Funds herein appropriated under U.S. Federal Grants shall not be available for obligation for their planned uses by the respective agencies until the respective grants have been awarded and the respective cash amounts have been drawn down by the State and are deposited in their respective State accounts and available for disbursement. (2) Lump-sum budget amounts shall not be advanced to any agency, with the exception of Yap Visitors Bureau, at the beginning of the fiscal year. Memorandum of agreement (MOA) or other forms of agreement the purpose of which is to obligate and disburse to a respective agency its annual budget as approved herein, including reimbursements to such agencies for payments for expenditures under their respective budget, is prohibited;

PROVIDED, however, that appropriated funds for Yap Visitors Bureau shall be granted pursuant to Section 2 of 6-24. All funds appropriated by this Act shall be maintained under the authority of the Director of the Office of Administrative Services, with the exception of Yap Visitors Bureau funds.

(3) Funds herein appropriated, with the exception of funds appropriated for Yap Visitors Bureau, shall be allotted only on a quarterly basis, except where it is essential for the effective and efficient performance of the duties and responsibilities of an agency to allot certain lump-sum amounts at the beginning of the fiscal year such as for the purchase of fixed assets and for contractual services.

(4) Unless otherwise specified in this Act, funds appropriated herein for personnel shall not be reprogrammed for other uses; except the Legislature specifically approves the following:

(a) Election Commissioner’s Office may reprogram $3,000 from Personnel to Fixed Assets. (ob) Office of the Governor may reprogram no more than $25,000 from Personnel for State

Funeral expenses.

(c) Yap State Legislature may

reprogram no more than $10,000 from Personnel to Travel.”

Section 2

This Act shall take effect upon the approval by the Governor, or upon its becoming law without

such approval.
